Coachways Bus Card – Terms & Conditions

1. General Terms

1.1 The Coachways Bus Card remains the property of Coachways Ltd.

1.2 Prospective passengers must purchase a Coachways Bus Card via the Coachways website and load the card with a prepaid amount.

1.3 It is the responsibility of the cardholder to ensure sufficient funds are available prior to travel.

1.4 Purchase or use of a Coachways Bus Card constitutes acceptance of these Terms & Conditions.

1.5 The purchase cost of a Coachways Bus Card is $50.00.

1.6 Only registered Coachways Bus Card holders may travel on Coachways services.

1.7 Adults are not permitted to travel on services operated exclusively for school routes.

2. Refusal of Service

2.1 Coachways reserves the right to refuse travel where a passenger is not registered, has insufficient funds, behaves inappropriately, or carries prohibited items.

2.2 Funds on a Coachways Bus Card may only be used on designated Coachways services.

3. Passenger Behaviour

3.1 Passengers must comply with all reasonable instructions from Coachways staff.

3.2 Eating, drinking, smoking, damaging vehicles, or interfering with safety equipment is prohibited.

4. Service Disruptions

4.1 Coachways is not liable for delays, cancellations, or breakdowns outside its reasonable control.

4.2 This clause does not affect any rights available under the Consumer Guarantees Act 1993.

4.3 No refunds or compensation will be offered where a fare has been collected but a service cannot be completed, except where required under the Consumer Guarantees Act 1993.

5. Card Funds

5.1 Funds loaded onto a Coachways Bus Card are non-refundable and non-transferable, except where required under the Consumer Guarantees Act 1993.

5.2 The Coachways Bus Card is not a credit or debit card.

6. Insufficient Funds

6.1 Travel may be declined where a card balance is insufficient.

6.2 Manual transactions and administration fees may apply as published.

7. Card Top-Ups

7.1 Online top-ups should be completed at least 12 hours before travel.

7.2 Direct credit transactions may take up to three business days.

8. Fees

8.1 Where a manual deduction is required, including where insufficient funds are available on the card, a manual processing fee of $3.00 will apply.

8.2 A fee of $5.00 will be charged for payments made directly to the Coachways bank account.

9. Fare Evasion

9.1 Deliberate fare evasion may result in suspension or cancellation of card access and refusal of travel on Coachways services.

10. No Refunds/Change of Mind

10.1 If for any reason a cardholder no longer wishes to use our services, the account will be closed and any balance remaining on the card will NOT be refunded.

10.2 Cardholders are encouraged to manage the balance of the card towards the end of the year.

10.3 This is considered a change of mind and does not give rise to a refund under the Consumer Guarantees Act 1993.

11. Lost or Damaged Cards

11.1 Lost or stolen cards must be reported promptly.

11.2 Coachways is not responsible for unauthorised use of a card either before or after it has been reported lost or stolen..

11.3 Replacement cards incur a $20.00 fee.

12. Changes to Terms

12.1 Coachways may amend these Terms & Conditions at any time.

13. Consumer Rights

13.1 Nothing in these Terms & Conditions limits or excludes any rights or remedies available under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

14. Introduction

14.1 Coachways Ltd is committed to protecting personal information in accordance with the Privacy Act 2020. This Privacy Policy forms part of these Terms & Conditions.

15. Personal Information We Collect

15.1 We collect personal information reasonably necessary to provide and administer services, including contact, account, ticketing, transaction, and usage information.

16. Collection and Use of Information

16.1 Personal information entered via the Coachways website is collected and stored using secure third-party systems.

16.2 Coachways has authorised access to personal information for service delivery, customer support, account management, and compliance purposes.

17. Disclosure of Information

17.1 Personal information will only be disclosed where required or authorised by law.

17.2 Where Coachways has a formal service agreement in place with a school for the provision of transport services, Coachways may confirm limited account status information strictly for administrative purposes directly related to transport services.

17.3 Any information shared will be limited to the minimum necessary and will not include detailed financial information, payment history, or transaction records.

17.4 Schools do not act as debt collection agents for Coachways and are not authorised to recover outstanding amounts.

17.5 Coachways will not disclose personal information to third parties for marketing purposes without consent.

18. Storage and Security

18.1 Reasonable steps are taken to protect personal information and ensure third-party providers maintain appropriate safeguards.

19. Access and Correction

19.1 Individuals may request access to or correction of personal information held by Coachways.

20. Complaints

20.1 Privacy complaints will be investigated and responded to within a reasonable timeframe.
